PROBATE REAL ESTATE TIMELINE

1.       Appointment of Administrator or Executor of the Estate—This person handles all affairs of the estate including the sale of real estate and liquidation of assets.

2.       The Sale of Property –No court confirmation is needed if the executor is granted “full powers” with no bond. The property may be listed normally and a sale executed given no objection to terms by other heirs. Court confirmation is needed if the executor’s powers are limited

3.       Accepting an Offer—If court confirmation is needed, an offer must be 90% or more of the appraisal value. A court hearing will be scheduled 30 to 45 days a petition is filed. Over bidding on the offer is accepted at time of the court hearing by outside buyers. A sale agreement can be executed with no contingencies and a 30 day escrow after the hearing.
